English-speaking criminal lawyers in Madrid
High-level, discreet criminal defence, available 24 hours a day. More than 15 years dedicated exclusively to criminal law.
Your defence in Madrid
Being investigated, arrested or charged in a foreign country is daunting: the procedure, the language and the deadlines are all unfamiliar, and the first hours are often decisive. At BP – Boutique Penal we are English-speaking criminal lawyers in Madrid, and we defend foreign residents, visitors and companies before the Plaza de Castilla courts, the Audiencia Provincial de Madrid and the Audiencia Nacional.
We practise criminal law exclusively, with more than 15 years of experience and a team of more than 30 criminal lawyers working across Spain from our office in Calle Velázquez, in Madrid’s Salamanca district. We explain every step in English, make sure your right to an interpreter is respected at the police station and in court, and act both for the defence and for victims who want to bring a private prosecution.
Leave your details in the form and one of our English-speaking lawyers will call you back. We are available 24 hours a day and your case is handled with absolute confidentiality.

Criminal defence in Madrid, in English
Arrest and police custody
If you or a family member have been arrested in Madrid, the first statement is the most important moment of the whole case. Police custody may last no longer than strictly necessary and never more than 72 hours before release or appearance before a judge (Article 17 of the Spanish Constitution).
Under Article 520 of the Criminal Procedure Act (Ley de Enjuiciamiento Criminal) you have the right to remain silent, to a lawyer of your choice, to a free interpreter and to have your consulate informed. We go to the police station or the duty court (juzgado de guardia), review the police report and prepare your statement with you before you say anything.
Many cases in Madrid are decided within days in fast-track proceedings (juicios rápidos). Accepting a conviction at the duty court can reduce the sentence by one third (Article 801 of the Criminal Procedure Act), but it leaves a criminal record: never agree to it without independent advice.
Drug offences
Spanish law draws a clear line between consumption and trafficking. Possession of drugs for personal use is not a crime, although using or carrying them in public places is an administrative offence punished with a fine (Organic Law 4/2015 on public safety). Drug trafficking, by contrast, carries prison sentences under Article 368 of the Criminal Code.
We defend foreign nationals in cases ranging from possession in nightlife areas to couriers stopped at Madrid-Barajas Airport and large investigations before the Audiencia Nacional. We scrutinise the search, the chain of custody and the laboratory analysis of the substance, and we argue for personal use whenever the facts support it.
Extradition and European Arrest Warrants
Extradition requests and European Arrest Warrants issued by other countries against people in Spain are dealt with by the Audiencia Nacional, Spain’s national high court, based in Madrid. Deadlines are short and the grounds for refusing surrender are limited, so the defence must be prepared from the moment of arrest.
We assist people detained under an international or European warrant, check the formal requirements and guarantees of the request, apply for release while the procedure is pending and coordinate with lawyers in the requesting country when needed.
Assault and violent offences
A night out that ends in a fight, an incident with door staff or an altercation in the street can lead to charges of assault and bodily harm (lesiones), public disorder or resisting the police. The outcome often depends on the medical reports, the witnesses and any CCTV footage, which must be secured early.
We defend people accused of violent offences and also act for victims, claiming compensation for injuries and damage. Where appropriate, we seek agreements that avoid a trial or reduce the consequences for your record.
Domestic and gender violence
Allegations of domestic or gender violence are handled in Madrid by specialised courts, the Juzgados de Violencia sobre la Mujer, and move very fast: an arrest, a statement at the duty court and a protection order can all happen within a day or two.
We defend the accused from the first hour, with particular attention to protection orders and their effect on the family home and on contact with children, and we also represent victims who need protection and want to bring a private prosecution.
Fraud and economic crime
Madrid concentrates much of Spain’s business activity and, with it, a large share of economic crime investigations: fraud, misappropriation, money laundering, tax offences and corporate criminal liability. Many of these cases involve foreign executives, investors and companies operating in Spain.
We defend individuals and companies under investigation and represent victims of fraud, including online investment and payment scams, before the Madrid courts and the Audiencia Nacional. In complex cases we work alongside forensic accountants and coordinate with your advisers in other countries.

What should I do if I am arrested in Madrid?
Stay calm, ask for a lawyer and an interpreter, and do not make any statement until you have spoken to your lawyer. You have the right to remain silent, and police custody may not exceed 72 hours. You can also ask for your consulate to be informed. A relative or friend can contact us through the form and one of our English-speaking lawyers will call back as soon as possible.
Will I have an interpreter at the police station and in court?
Yes. Spanish law guarantees a free interpreter to anyone who does not speak or understand Spanish, both at the police station and in court, as well as the translation of essential documents (Article 123 of the Criminal Procedure Act). With us you also have a lawyer who explains every step of the case to you in English.
Can I leave Spain while the case is open?
It depends on the precautionary measures imposed by the judge. You may be required to stay in Spain, to surrender your passport or to report to the court periodically, and breaching these measures can lead to custody. If you need to travel or return home, we can ask the court to change the measures or to let you take part by videoconference when the law allows it.
Can a criminal conviction affect my residence permit or lead to expulsion?
It can. A criminal record may prevent the renewal of a residence permit or an application for Spanish nationality, and under Article 89 of the Criminal Code prison sentences of more than one year imposed on foreign nationals may be replaced, in whole or in part, by expulsion from Spain. We take your immigration situation into account from the start of the defence.
How much does a criminal lawyer in Madrid cost?
Fees depend on the type of offence, the complexity of the case and the stage of the proceedings. After the first consultation we give you a written engagement letter with a clear, fixed quote, with no obligation, so you know from the outset exactly what our work includes.
Do you also represent victims of crime?
Yes. In Spain a victim can join criminal proceedings as a private prosecutor (acusación particular), propose evidence and claim compensation. We represent foreign victims of theft, fraud, assault and sexual offences, and we can continue the case on your behalf if you have already returned to your country.
